Refund if your petition is denied

It will not change. Extra reviews, re-preparation, urgent consultations — everything is included.

Three rounds of review

Attorney → coordinator → final cross-check. A single typo can be enough for a USCIS officer to deny. We make sure that never happens.

Visa programs

O-1 and EB-1A — two US pathways for professionals with achievements

The talent visa is the informal name for two US immigration programs designed for professionals with extraordinary abilities. Both programs are open to IT specialists, scientists, doctors, entrepreneurs, artists and athletes — and people in a great many other professions. The key requirement is provable achievements in your field — not an academic degree or a Nobel Prize.

Non-immigrant visa

O-1 — the talent work visa

A work visa for the length of your contract (up to 3 years, renewable). A good fit if you want to work in the US but are not ready for a permanent move yet. Not tied to quotas — you can file at any time. After O-1 you can move to the EB-1 visa and obtain a Green Card while already inside the US.

  • File at any time — no quotas
  • Fast results: approval in 1–3 months
  • Spouses and children receive O-3 status
Immigrant petition

EB-1A — the talent Green Card

A direct path to a Green Card with no employer sponsor. EB-1A approval grants permanent residence in the US for you and your immediate family.

  • No employer sponsor required
  • Your family gets Green Cards along with you
  • Eligible for US citizenship after 5 years
When to choose O-1
  • You want to “try out” life in the US without triggering automatic tax obligations.
  • You are not fully confident in your achievements and want to spend less effort building the evidence portfolio.
  • You do not want a long wait for the visa to be stamped into your passport.
  • You want to move to the US sooner.
  • You want higher odds of visa approval.
When to choose EB-1
  • Moving to the US is a 100% deliberate decision for you — you know for sure you are ready to immigrate.
  • You want your family members to have the same right to work as you do.
  • You are confident in your achievements.
  • You are ready to put more effort into building the evidence portfolio.
  • Your dream is to get a Green Card.

8 USCIS criteria

USCIS criteria — you only need to meet a few

USCIS evaluates talent visa applicants against several criteria. You do not need to satisfy them all — convincingly proving three to four is enough, depending on the visa type. The goal is to build an evidence portfolio of 300-1500 pages that presents your achievements in the best possible light. At Migrator we usually file at least 5 criteria to keep a safety margin in case the officer rejects one of them.
  1. 01

    Awards and prizes

National or international awards for professional achievement. It does not have to be an Oscar — industry awards, hackathon wins, and professional competitions count too. We select the right events individually, based on your field.

  2. 02

    Membership in associations

Membership in organizations that require outstanding achievements to join. IEEE, ACM, professional medical and scientific societies. Migrator keeps a vetted list of organizations recognized by USCIS.

  3. 03

    Press coverage

Articles about you or your work in professional or major media outlets. Interviews, project reviews, mentions in industry media.

  4. 04

    Judging and expert review

Serving on competition juries, peer-reviewing academic papers, evaluating grant applications, assessing startups.

  5. 05

    Original contributions

Patents, proprietary methodologies, open-source projects, scientific discoveries — anything that has influenced your industry.

  6. 06

    Authorship of scholarly articles

Publications in peer-reviewed journals, conference talks, book chapters. Your citation index matters.

  7. 07

    Work for leading organizations

A key role at companies with a distinguished reputation. Leadership positions, senior management, research and scientific work.

  8. 08

    High income

A salary or fees above the industry average in your region. Documented with contracts, bank statements, and tax returns. Keep in mind that the comparison is against professionals just like you in your field — not against some specific number with lots of zeros.

Don't put it off

Start your US journey today — later it only gets harder and more expensive

Requirements keep tightening

US immigration policy is changing. Criteria that pass today may not be enough a year from now. Cases approved in 2024 already require a stronger evidence portfolio in 2026.

Processing times are growing

Standard petition processing keeps getting longer. What used to take 3 months can now take 6. The sooner you file, the sooner you get a result.

Achievements lose relevance

A 2022 publication carries more weight than the same publication in 2028. A three-year-old award is more convincing than a ten-year-old one. The fresher your achievements, the stronger your case.

The adaptation window for your family is closing

Children adapt more easily at 5 than at 12. It is easier for a spouse to restart a career at 35 than at 45. Every year of waiting is a year your family could have spent settling into a new life.
