EB-3 is an employment-based immigrant category that grants a Green Card to the whole family of skilled workers, degree-holding professionals, and workers without special qualifications. No scientific publications, patents, or extraordinary achievements are required — what matters is having a US employer sponsor.
The defining feature of EB-3 is the mandatory Labor Certification (PERM) process. The employer must prove to the US Department of Labor that no qualified American workers were available for the position. It is the longest stage (6-10 months), but Migrator handles PERM preparation and filing entirely for you.

At least 2 years of professional experience or training. Programmers, engineers, electricians, welders, cooks, medical technicians. No degree needed — documented experience is what counts.

A US bachelor's degree or its equivalent. Accountants, teachers, marketers, engineers, nurses with a degree. Positions where holding a degree is a mandatory requirement of the job.

No 2 years of experience or degree required. Assistants, caregivers, laborers. A separate annual quota — the visa bulletin backlog can be longer.

Check if I qualifyAn American company willing to act as the petitioner and go through PERM. It must prove its financial ability to pay the wage — through tax returns or audited financial statements.
The US Department of Labor must confirm that no qualified American workers are available for the position. The employer posts job ads, interviews the candidates who respond, and documents the process.
For Professionals — a US bachelor's degree or its equivalent (with a credential evaluation). For Skilled Workers — at least 2 years of training or experience. For Other Workers — no special requirements.
At least 2 years of documented experience for Skilled Workers — employment records, reference letters, job descriptions. Other Workers need no experience; for Professionals it depends on the job requirements.
The employer must pay at least the prevailing wage for the position in the region — as determined by the Department of Labor. A salary below the prevailing wage means a PERM denial.
The job must be full-time and permanent (not temporary or seasonal). Project-based contracts and part-time roles do not qualify for EB-3.
No deportations, visa violations, serious offenses, or misrepresentations to USCIS. If you have prior visa denials — be sure to tell your attorney before the I-140 is filed.

Get started| Stage | Timeframe |
|---|---|
| Case assessment and contract | 1-2 weeks |
| PERM preparation and filing | 12-18 months |
| I-140 processing (standard) | 4-12 months |
| I-140 processing (Premium) | 15 business days |
| Consular processing or I-485 | 3-8 months |
| Total (standard path) | 1.5-2.5 years |
The longest and least predictable stage is PERM. The Department of Labor may order an audit, which adds 6-12 months. Speed depends on how complete the employer's documents are and how precisely the job is described.
Another factor is the visa bulletin. For Other Workers and applicants from heavily backlogged countries (India, China), waiting for a visa number can add another 1-3 years to the standard timeline.
Every case is handled by a licensed US attorney. The company takes on the financial risk — it is written into the contract.

The Department of Labor orders audits more and more often and demands more detailed documentation of the search for American candidates. Cases from 2024 will need stronger evidence in 2026.
Standard Labor Certification processing keeps getting longer. What used to take 8-10 months can now take 14-18. The sooner you start, the sooner you get a result.
For Other Workers and applicants from India and China, the wait for a visa number takes years. Every month of delay is a month in line that stacks on top of the standard timeline.
Children adapt more easily at 5 than at 12. It is easier for a spouse to restart a career at 35 than at 45. Every year of waiting is a year your family could have spent in the US with a Green Card.
