What the EB-3 visa is and who it is for

EB-3 is an employment-based immigrant category that grants a Green Card to the whole family of skilled workers, degree-holding professionals, and workers without special qualifications. No scientific publications, patents, or extraordinary achievements are required — what matters is having a US employer sponsor.

The defining feature of EB-3 is the mandatory Labor Certification (PERM) process. The employer must prove to the US Department of Labor that no qualified American workers were available for the position. What it takes to get EB-3 approved — 7 key requirements

Unlike EB-1 / EB-2 NIW, EB-3 has no “3 out of 10” criteria. Here you need to meet every baseline requirement. What matters most is an employer sponsor and a successfully completed Labor Certification (PERM). Migrator handles PERM end to end — from the job description to audit defense.

    A US employer sponsor

    An American company willing to act as the petitioner and go through PERM. It must prove its financial ability to pay the wage — through tax returns or audited financial statements.

    Labor Certification (PERM)

    The US Department of Labor must confirm that no qualified American workers are available for the position. The employer posts job ads, interviews the candidates who respond, and documents the process.

    Education matching the subcategory

    For Professionals — a US bachelor's degree or its equivalent (with a credential evaluation). For Skilled Workers — at least 2 years of training or experience. For Other Workers — no special requirements.

    Work experience in your field

    At least 2 years of documented experience for Skilled Workers — employment records, reference letters, job descriptions. Other Workers need no experience; for Professionals it depends on the job requirements.

  5. 05

    Meeting the prevailing wage

    The employer must pay at least the prevailing wage for the position in the region — as determined by the Department of Labor. A salary below the prevailing wage means a PERM denial.

  6. 06

    A full-time, permanent position

    The job must be full-time and permanent (not temporary or seasonal). Project-based contracts and part-time roles do not qualify for EB-3.

  7. 07

    A clean immigration record

    No deportations, visa violations, serious offenses, or misrepresentations to USCIS. If you have prior visa denials — be sure to tell your attorney before the I-140 is filed.

The longest and least predictable stage is PERM. The Department of Labor may order an audit, which adds 6-12 months. Speed depends on how complete the employer's documents are and how precisely the job is described.

Another factor is the visa bulletin. For Other Workers and applicants from heavily backlogged countries (India, China), waiting for a visa number can add another 1-3 years to the standard timeline.
